§ 1 Provider and scope

These General Terms and Conditions apply to all contracts between

Firat Kilic
Schlachthofstraße 61

Germany
Email: info@inseratcheck.de
VAT ID: DE316457207

(hereinafter “Provider”) and consumers or businesses (hereinafter “Users”) who use the Provider’s digital services via the website inseratcheck.de.

Deviating terms of the User are not recognised unless the Provider expressly agrees to their validity in writing.

§ 2 Description of services

2.1 Listing analysis

InseratCheck is a digital analysis tool that automatically evaluates vehicle listings. The analysis is based exclusively on publicly available information and the text of the listing.

The analysis provides indications of possible anomalies, missing information and potential risk factors.

Important: The analysis is not a technical inspection, not an expert appraisal and not legal advice. The results are non-binding indications and serve solely as guidance.

The Provider gives no guarantee as to the completeness, accuracy or timeliness of the analysis results. Purchase decisions are made solely at the User’s own risk.

2.2 Access plans

Paid access is offered to Users outside Germany:

  • 7-day access: €4.99 incl. VAT
  • 30-day access: €9.99 incl. VAT

Both packages include unlimited access to the analysis features during the respective term. Payment is made once. There is no subscription and no automatic renewal.

For Users located in Germany, use of the analysis is currently free of charge.

2.3 Arranging vehicle inspections

The Provider additionally offers the option of arranging vehicle inspections at independent partner workshops. In doing so, the Provider acts exclusively as an intermediary. A contract for carrying out a vehicle inspection is concluded exclusively between the User and the respective workshop.

The respective workshop alone is responsible for carrying out the vehicle inspection, its quality and its results.

Only partner workshops that have been approved and have a complete profile and a payment account are suggested. They are sorted solely by distance (as the crow flies) to the postcode entered; there is no paid placement. The partner workshops are businesses.

The inspection report prepared by the workshop is a snapshot at the time of the inspection and contains no guarantee or assurance regarding the future condition of the vehicle.

2.4 Booking procedure

  1. The User requests an appointment with a partner workshop via the website. The request is free of charge and non-binding.
  2. The workshop confirms an appointment, proposes another one or declines. At the User’s request, the Provider forwards the request to another workshop within the selected radius.
  3. After confirmation, the User sees the workshop (name, address, contact details), the appointment and the total price. The price is set by the workshop and amounts to no more than €118.00 incl. VAT.
  4. By clicking “Book with obligation to pay” and completing payment successfully, the contract for the vehicle inspection is concluded between the User and the workshop. Payment is made via the payment service provider Stripe directly to the workshop. If payment is not made within the period shown, the appointment lapses at no cost.
  5. The invoice for the inspection is issued by the workshop. The workshop pays the Provider a fee for the arrangement; this does not result in any additional costs for the User.

2.5 Rescheduling, cancellation and no-show

Until the appointment begins, the User can reschedule it free of charge via the link in their confirmation. To do so, they propose new dates at the same workshop; until the workshop confirms one of them, the existing appointment remains valid.

Until the appointment begins, the User can terminate the contract free of charge using the “Withdraw from contract” button; the amount paid will be refunded in full. Their statutory right of withdrawal (§ 5) remains unaffected.

If the workshop cancels the appointment, the amount paid will be refunded in full.

If the User does not attend the appointment without cancelling, the price generally remains payable. The User may prove that the workshop has suffered no damage or significantly less damage. The statutory right of withdrawal remains unaffected. The User can object to the “did not attend” report via their appointment page.

If a User has failed to attend several times within twelve months without cancelling, the Provider may, after reviewing the individual case, exclude them from further appointment requests for up to twelve months. The User will be informed of this by email and can contact the Provider at any time.

§ 3 Conclusion of contract

The contract for paid access is concluded as soon as the User successfully completes the payment process. Access is activated immediately after successful payment.

Registration or a user account is not required. Access is provided through a technical assignment in the browser (e.g. a cookie or comparable technology) for the duration of the booked term.

The contract can be concluded in German, English, French, Italian, Spanish, Dutch, Russian or Turkish. Translations of these terms are provided for understanding; in the event of discrepancies, the German version prevails to the extent permitted by law.

Before submitting an appointment request, the User can check all information in the form and change it at any time. Before payment, the appointment page shows the workshop, the appointment and the total price. Until payment is completed, the User can correct input errors using the input fields, the browser’s back function or by cancelling the process; no costs arise without payment.

The Provider stores the contract data (workshop, appointment, price and the User’s information). The User receives it by email with the payment confirmation, together with the withdrawal information, and can access their booking at any time via the link in their emails. These terms are available at any time at inseratcheck.de/agb/ and can be saved or printed.

The Provider has not subscribed to any specific codes of conduct.

§ 4 Prices and terms of payment

All prices stated are final prices in euros and include statutory VAT.

Payment is made via the payment service provider PayPal. PayPal’s terms of use and privacy policy apply. Payment is due immediately upon conclusion of the contract.

§ 5 Right of withdrawal

Consumers generally have a statutory right of withdrawal of 14 days.

Vehicle inspections: The contracting party is the workshop. The workshop’s withdrawal information and the model withdrawal form are displayed before payment and sent by email together with the payment confirmation. Withdrawal can be declared using the “Withdraw from contract” button; the Provider receives it on behalf of the workshop and confirms receipt immediately by email. If the inspection is to take place within the withdrawal period, the User expressly requests this before payment; the right of withdrawal then expires as soon as the inspection has been fully carried out.

Expiry of the right of withdrawal for digital content: The right of withdrawal expires early if the User expressly agrees that the Provider begins performing the contract before the withdrawal period ends and at the same time confirms that they lose their right of withdrawal once performance begins. Consent is given by actively ticking a checkbox before payment.

For analysis access: since access is activated immediately after payment and the service can be used straight away, there is in principle no entitlement to a refund once access has been activated.

§ 6 Liability

The Provider is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.

Otherwise, the Provider is liable only for breach of material contractual obligations. In such cases, liability is limited to the foreseeable damage typical for the contract.

The Provider accepts no liability for decisions made on the basis of the analysis.

§ 7 Data protection

Information on the processing of personal data is available in the privacy policy.

For payment processing, personal data is transmitted to the respective payment service provider (Stripe or PayPal). For a requested vehicle inspection, the Provider passes on the name, contact details and vehicle information to the workshop requested.

Cookies or comparable technologies are used to provide access technically. These may contain pseudonymous identifiers to enable access during the booked term.

§ 8 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
